Medicredit, Inc. is a large collections agency focused exclusively on medical and healthcare debts. Unlike most collections agencies, Medicredit does not buy the debts it collects, but rather solely makes collection calls on behalf of the creditors contracting with their agency. Medicredit has offices all over the U.S. and makes collection calls in all states, with calls totaling over 2.9 million every year.
Due to the relatively low number of complaints made to the Better Business Bureau compared to the number of calls made yearly, the BBB has recently upgraded Medicredit’s BBB rating to an A+, yet Medicredit remains an unaccredited business. Customer reviews on the BBB website paint a less positive picture, with an overall “negative experience” score and 3.68 out of 5 star rating.
Aside from the negative reviews on the BBB website, Medicredit has received multiple legal complaints for abuses under the Fair Debt Collection Practices Act (FDCPA), some of which have been settled and others which are still pending. In addition to complaints of FDCPA violations, Medicredit has recently been subject to a large class action lawsuit under the Telephone Consumer Protection Act (TCPA).
Under this lawsuit, John Prater alleged that Medicredit routinely violated the TCPA “by placing non-emergency telephone calls to the cellular telephones of consumers using an automatic telephone dialing system and/or an artificial or prerecorded voice, without the prior express consent of the consumers.” Medicredit continues to deny wrongdoing, but settled with the class for a $6.75 million common fund award in the United States District Court for the Eastern District of Missouri on December 7, 2015.
Any person who qualifies under the following conditions may claim their portion of the award:
• Medicredit, Inc. and/or The Outsource Group called you at least once from January 28, 2010 to July 13, 2015
• The call came to your cell phone
• The call used an automatic telephone dialing system and/or an artificial or prerecorded voice
• You had not given previous valid consent for such calls
