Debtor Defense Leads to Reduced Bill
Ohio debtor defense attorney Jeremiah Heck helped a marketing salesman to settle an alleged $13,500 debt for less than 25 percent of the balance owed.
The salesman was sued in the Franklin County Municipal Court by Midland Funding, a company that buys unpaid debts and then aggressively attempts to collect them. The company previously had harassed the salesman with multiple phone calls and rude conduct.
The suit claimed that he owed the debt to Midland Funding. But the company didn’t have the proper documentation to prove it owned the original account. Heck argued in his debtor defense that the original creditor could have transferred the account into a trust that was used for collateral for certain securities. Also, the company lacked documentation of the alleged balance.
Because of the flaws in the company’s case against the debtor, Heck was able to help the salesman resolve the suit out of court. He’ll pay significantly less than the amount the company said he owed, and he’ll be able to pay the reduced debt off over 24 months.
